Terms of Sale

Article 1 – The service
Aix Alain Taxi offers customers a taxi service in a sedan or minibus by calling or by prior reservation.

Article 2 – Access to the service
The customer who wishes to have the services of Aix Alain Taxi can contact one of the company’s taxis directly at a taxi rank, on simple call or must make a reservation by telephone, fax or email. To validate a reservation, the customer must provide some information, in particular his name, his mobile number, his email address, the pick-up address and the destination address for a transfer.

Article 3 – Rates and terms of payment
Taxi fares are set by the Prefecture of Bouches-du-Rhône. For the year 2018 they break down as follows: coverage for €2.10; day rate (rate C) = €1.74/km; night rate (rate D) = €2.24/km. The minimum charge is €7.10. The advertised prices are inclusive of VAT (with 10% VAT). Only toll charges and supplements can be requested in addition to the meter. An invoice is issued from 25 € obligatorily, or on request of the customer below 25 €. In the event of a dispute, only the price entered on the meter will prevail.
Payment can be made in cash, by credit card (Visa, Mastercard, American Express, VAD) or by bank transfer. The payment in monthly invoice is subject to a prior agreement between Aix Alain Taxi and the Customer, in this case the payment will be made upon receipt of invoice.

Article 4 – Waiting
The hourly waiting rate is €28.50.

Article 5 – Cancellation conditions
Any modification or cancellation of a reservation must be made no later than 1 hour before the initial reservation. Any service canceled less than an hour before will be due in full.

Article 6 – Down payment
For any reservation of an amount greater than 500 euros, payment of a deposit of 25% of the total amount of the service will be requested at the time of reservation.

Article 7 – Garage location
Aix Alain Taxi vehicles are parked in the city of Aix-en-Provence. En cas de déplacement nécessitant l’hébergement du chauffeur, les nuitées de celui-ci restent à la charge du client, ainsi que ses repas.

Article 8 – Lateness
It is expressly agreed that delays in transport times due to unforeseen traffic difficulties (traffic jams, accidents, deviations, weather conditions, miscellaneous events, etc.) do not give way any kind of compensation.

Article 9 – Animals
The transport of animals in the vehicles of Aix Alain Taxi may be authorized if they are transported in a transport box provided for this purpose and that there is no risk of damaging the vehicle in question.

Article 10 – Luggage
A supplement of €1.10 per piece of luggage may be charged. However, throughout the duration of the service, the luggage remains the responsibility of its owner. Aix Alain Taxi could not be held responsible in the event of loss of personal effects and luggage forgotten in its vehicles.

Article 11 – Services and liability of Aix Alain Taxi
Aix Alain Taxi undertakes to do what is necessary to bring the passenger(s) to their destination as soon as possible and in optimal safety conditions. As such, the driving and custody of the vehicle belongs to Aix Alain Taxi, which meets the requirements of the Highway Code. Aix Alain Taxi is guaranteed by a notoriously solvent insurance company which covers the risks related to its activity in accordance with the legislation in force. Passengers, third parties with regard to the driver, are covered for all bodily, material and immaterial damage that they may suffer as a result of a traffic accident and this in an unlimited manner, from getting into the vehicle until the descent, except for damage caused by their fault.
In the event of damage to the equipment or the vehicle due to the passenger, any repair or change of the equipment, whatever the causes, will be invoiced to the Customer. Any damage caused to a third party as a result of passenger behavior that does not comply with basic safety rules would be the Customer’s responsibility.

Article 12 – Safety instructions
Wearing a seat belt is compulsory in vehicles. It is strictly forbidden to take any part of the body out of the windows or sunroofs of the vehicles. For safety reasons, it is forbidden to smoke, to transport flammable, explosive, corrosive or toxic substances. Failure to comply with this stipulation engages the responsibility of the Customer and the passenger. Aix Alain Taxi then reserves the possibility of any possible recourse.
Aix Alain Taxi reserves the right to disembark its passenger from the vehicle if the latter does not comply with the safety instructions set out by Aix Alain Taxi and this without it being possible to demand reimbursement of the fare.
The driver reserves the right to stop the service in progress in the event of illegal, dangerous, insulting or non-compliant behavior with these general conditions, without any possible refund. Likewise for customers who are very intoxicated.

Article 13 – Complaint
Any complaint to Aix Alain Taxi will only be accepted within 7 days of the performance of the service, by registered letter with acknowledgment of receipt.

Article 14 – Allocation of powers
These general conditions of sale are subject to French law. In the event of a dispute, only the courts of Aix-en-Provence will have jurisdiction.
